1. Acceptance of Terms
By accessing or using BugValluk, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, you must immediately stop using the platform.
2. About BugValluk Services
BugValluk provides continuous penetration testing, vulnerability validation, remediation guidance, and security reporting. We may enhance, modify, suspend, or discontinue features to maintain performance and adapt to emerging threats.
3. Accounts, Eligibility, and Authority
You must have legal authority to bind your organization and ensure users comply with these terms. You are responsible for maintaining the confidentiality of credentials and for all activity under your account.
4. Authorized Security Testing
You may only submit assets you own or are expressly authorized to test. Unauthorized testing of third-party assets is strictly prohibited. You are responsible for defining clear scope, change windows, and any safety constraints.
5. Customer Responsibilities
You will provide accurate asset details, promptly apply remediation guidance, and ensure your environments are prepared for testing (including backups and monitoring). You remain responsible for your infrastructure, configurations, and access controls.
6. Confidentiality and Data Handling
Vulnerability data, reports, and communications are confidential. We share findings only with authorized contacts you designate. We may collect and analyze usage and telemetry to improve the service while applying appropriate safeguards, including encryption in transit, role-based access, and least-privilege controls where feasible.
7. Compliance and Cross-Border Use
BugValluk operates from Bangladesh with global service delivery. You are responsible for complying with applicable laws where you operate, including export controls, sanctions, data protection (e.g., GDPR where applicable), and sector-specific regulations. By using the platform internationally, you authorize cross-border data transfers needed to deliver the service and will not use the service in jurisdictions where such transfers would be unlawful.
8. Intellectual Property
BugValluk owns all rights to the platform, tooling, methodologies, and deliverables we originate. You retain ownership of your data and assets. No rights are granted except those necessary for you to use the service during your subscription.
9. Findings Delivery and Collaboration
Findings are delivered through the BugValluk portal and agreed notification channels. You are responsible for reviewing reports, validating fixes, and coordinating any production changes in line with your change-control processes.
10. Plans, Fees, and Lifetime Offers
Fees, payment terms, and renewal details are defined in your order. Where a lifetime or fixed-term offer is provided, access lasts for the stated duration of BugValluk's availability, and we may refine scope or features after an initial 12-month period to maintain service quality. Such offers are non-transferable and non-refundable unless required by law.
11. Third-Party Services
The platform may integrate with third-party tools (e.g., ticketing, messaging). Your use of those tools is subject to their terms, and BugValluk is not responsible for third-party services.
12. Warranties and Disclaimers
The service is provided on an “as is” and “as available” basis. We do not guarantee that all vulnerabilities will be identified or that services will be uninterrupted, timely, or error-free.
13. Limitation of Liability
To the fullest extent permitted by law, BugValluk's total liability for any claim is limited to the fees you paid in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, revenue, or data.
14. Indemnification
You agree to indemnify and hold BugValluk harmless from claims arising out of your misuse of the service, violation of these terms, or unauthorized testing of assets.
15. Suspension and Termination
We may suspend or terminate access for breach of these terms, security risks, non-payment, or unlawful activity. You may terminate by providing written notice in line with your order terms.
16. Governing Law
These terms are governed by the laws of Bangladesh, with cross-border operations conducted in accordance with applicable international standards and mandatory local laws where you operate. Conflict-of-law principles that would result in another jurisdiction's law applying are excluded.
